<p>HMEA is officially known as Horrace Mann Education Associates and has a longstanding tradition of supporting educational initiatives for people with disabilities within the Franklin community. Although many communities celebrate Horrace Mann for his important feats in the educational world, his cause is even more pertinent in Franklin, where the educator was born. HMEA serves over 2,500 clients throughout Rhode Island and Massachusetts.</p>

<p>The Annual Independence 5K is a critical fundraiser for HMEA. The race is designed to promote awareness and raise money. Cardi&#8217;s has consistently participated in the cause. The 2012 race will take place on Sunday, May 20 at the Franklin Industrial Park. Registration will be at 10 with the actual race starting at 11. Additional activities will include a raffle, a kids&#8217; race, food, prizes and more.</p>

<p>To promote awareness of the race, representatives from Cardi&#8217;s Furniture visited The Rhode Show, sharing information about the race and their deep rooted commitment to the work of HMEA. Among those representing Cardi&#8217;s were Nick Cardi and the rest of the NiRoPe trio. They were joined by Doug MacPherson, who currently serves as Vice President of Development and Public Relations for HMEA. Together, they discussed the race and the purpose of the organization, while also highlighting other events sponsored by Cardi&#8217;s Furniture.</p>

<p> FairPoint Communications, Vermont Attorney General William Sorrell, AARP Vermont and Rutland City Police Department held a press conference today to raise awareness about a telephone scam originating from the Jamaican 876 area code that targets seniors in Vermont and across northern New England. FairPoint also unveiled a Public Service Announcement and expanded website, http://www.bewareof876.com, with resources to identify and prevent phone scams. </p>
<p>&#13;</p>
<p>Today’s press conference was prompted by information about a Rutland-area senior who received nearly 30 phone calls from the 876 area code in less than a month’s time. This is just the latest in an alarming of number of cases of telephone scams originating from the 876 area code have been reported in Vermont, according the Vermont Attorney General’s office and FairPoint Communications.</p>
<p>&#13;</p>
<p>“Vermonters receiving an unexpected call from area code 876 should be on high alert. These calls are almost certainly from scam artists,” said Vermont Attorney General William Sorrell. “We are pleased to join forces with FairPoint Communications, law enforcement officials, local authorities, seniors’ organizations, and others to warn the public about so-called ‘Jamaican scams.’ Money sent to these thieves is gone for good. Joint efforts, like this, are key to preventing devastating losses.” </p>
<p>&#13;</p>
<p>The Attorney General reports that his office receives more than 1,000 calls per year on phone scams, of which approximately 20 percent involve calls from Jamaica.  </p>
<p>&#13;</p>
<p>Over the last two years, some Vermonters who notified his office about scams originating in Jamaica reported losses between several hundred dollars and $  18,000, with many in the range of $  2,000 to $  6,000. </p>
<p>&#13;</p>
<p>While this is the first case reported to the Rutland Police of a telephone scam originating from area code 876 in Rutland, police believe there are more victims who are afraid or ashamed to come forward, said interim Rutland Police Chief Jim Baker. “If you have received suspicious calls from unfamiliar numbers please contact local authorities or your telephone provider. Together we can stop this scam and protect our seniors.”  </p>
<p>&#13;</p>
<p>FairPoint launched the “Beware: Scams from Area Code 876” campaign in late March in response to these scams and created a website, http://www.bewareof876.com for tips on preventing phone scams. The announcement gained national and international attention, prompting additional media coverage that forced the Jamaican government to establish a task force to address the 30,000 calls made from Jamaica into the U.S. attempting to defraud American citizens every day.</p>
<p>&#13;</p>
<p>An Associated Press report noted conservative estimates that put the yearly take from Jamaican scams at $  300 million, up from about $  30 million in 2009.</p>
<p>&#13;</p>
<p>“We know that Vermont seniors are regular targets of scams originating from area code 876. Our goal is to help shed light on the abusive treatment of seniors and provide resources to family members, law enforcement and senior organizations to identify and prevent these scams,” said Mike Smith, Vermont state president of FairPoint Communications. “We recently expanded http://www.bewareof876.com to provide additional tools and resources and have developed a compelling Public Service Announcement that is available to download.”</p>

<p>The scam works as follows: &#13;<br />
</p>
<p>&#13;<br />
     Seniors receive a call from an 876 area code, which is often mistaken for a toll-free number and are congratulated for winning the Jamaican lottery, new car or new home. They are then are directed to send a fee, typically $  150-$  250, according to Sorrell, purportedly to process the lottery winnings. They are told that once the fee is received, money will be wired to their bank account and the car will be delivered to their home. &#13;</p>
<p>     Many times the caller will tell the victim that a representative of the lottery is in the area and as soon as the process fee is received, someone will deliver a check to their home. Scammers often use Google Earth to identify local landmarks and make the scam more believable.&#13;</p>
<p>     A key to the scammer’s success is convincing victims to promise not to tell their family members and to make it a big surprise. If the scammers feel they have a potential victim, the calls will increase in frequency, resulting in hundreds of calls. &#13;</p>
<p>     The money is requested through a wire from Western Union, Green Dot Card or in a creative way such as putting $  100 bills in each page of a magazine.
<p>“We very concerned about the proliferation of new scams targeting older residents in Vermont,” said Greg Marchildon, AARP Vermont state director. “Sadly, seniors are more vulnerable than others in this regard as they are more often home to answer the phone, are generally trusting of others and many times have assets they can easily access. We’re pleased to help alert Vermonters as to how to avoid being a victim, and we support the Beware: Scams from Area Code 876 campaign and any law enforcement efforts to address this problem.”</p>

<p> An article appearing in the March 2012 edition of the &#8220;North Carolina Law Review,&#8221; Cooper J Strickland, &#8220;The Dark Side of Unattributed Copying and the Ethical Implications of Plagiarism in the Legal Profession,&#8221; 90 N.C. L. Rev. 920 (2012), addresses the issue of plagiarism in the legal profession. While the law review article focuses mostly on the ethical issues for lawyers, it is also important for both paralegals and students pursuing a bachelor of science in paralegal to understand the definition of plagiarism, the potential consequences for plagiarism, and how to avoid plagiarism.</p>
<p>&#13;</p>
<p>What is Plagiarism?</p>
<p>&#13;</p>
<p>Plagiarism is defined by Black’s Law Dictionary as “[t]he deliberate and knowing presentation of another person’s original ideas or creative expressions as one’s own.”&#13;<br />
<br />Merriam-Webster’s Online Dictionary defines “plagiarize” as “to steal and pass off (the ideas or words of another) as one’s own; to use (another’s production) without crediting the source; to commit literary theft; to present as new and original an idea or product derived from an existing source.”</p>
<p>&#13;</p>
<p>Defining and identifying plagiarism can sometimes be a challenge and the situation should be looked at on a case-by-case basis. A standard definition is not possible because of context. One good online source for plagiarism is the website at http://www.plagiarism.org maintained by the plagiarism detection software company iParadigms, LLC that owns TurnitIn software. Plagiarism.org provides the following situations as potential forms of plagiarism: 1) turning in someone else’s work as your own; 2) copying words or ideas from someone else without giving credit; 3) failing to put a quotation in quotation marks; 4) giving incorrect information about the source of a quotation; 5) changing words but copying the sentence structure of a source without giving credit; and 6) copying so many words or ideas from a source that it makes up the majority of your work, whether you give credit or not.</p>
<p>&#13;</p>
<p>Even if you cite the source, copying so many words or ideas from a source that it makes up the majority of your work or a large percentage of the work may constitute plagiarism. It is important to have original analysis in any written paper, assignment, memorandum, or brief while still citing sources.</p>
<p>&#13;</p>
<p>What are the Potential Consequences for Plagiarism?</p>
<p>&#13;</p>
<p>The conclusion in the &#8220;North Carolina Law Review&#8221; article states that it is possible for an attorney to commit plagiarism and to be punished for it as an ethical violation. A lawyer can face discipline from the state bar or the state supreme court for plagiarism. The court may also not award attorneys’ fees if the work is not original.</p>
<p>&#13;</p>
<p>Along with the potential consequences for an ethical violation for lawyers, there are also potential copyright issues with plagiarism and using legal briefs. In February 2012, two lawyers, Edward White and Kenneth Elan, filed a class action suit against the parent companies of Westlaw and LexisNexis for using briefs in the brief banks sold by their respective companies without permission. The case name is White et al. vs. West Publishing Corp. et al., U.S. District Court, Southern District of New York, No. 12-1340.</p>
<p>&#13;</p>
<p>Students who plagiarize material can face serious consequences. Some of the potential repercussions for plagiarizing material in a paper or written assignment include failure of the assignment, failure of the course, and possible expulsion from the college or university. Be sure to check the syllabus and university catalog for more information on academic honesty.</p>
<p>&#13;</p>
<p>Two Ways You Can Avoid Plagiarism</p>
<p>&#13;</p>
<p>Knowing that plagiarism can result in serious consequences, how can you avoid plagiarism? Here are two ways to avoid it:</p>
<p>&#13;</p>
<p>           1.    Give credit where credit is due: The top way to avoid plagiarism is to properly give credit where credit is due. Citing sources is critical. Learn and use the proper citation formats such as APA, MLA, Bluebook, or Chicago style. Even if the citation format is not perfect, an attempt to cite a source is much better than not citing the source at all. Most people don’t learn how to cite sources overnight and being able to properly cite sources is a good skill you can acquire and develop through time, practice and experience.</p>
<p>&#13;</p>
<p>           2.    Seek a second opinion: If a paralegal student is unsure if something is considered plagiarism, the student should contact the instructor for clarification. Send a draft of the assignment to your instructor via email and ask for an opinion and review. Just make sure to provide sufficient time for the instructor to review the draft and don’t wait until the last minute before the assignment deadline. If a working paralegal has questions whether a written work is plagiarized, consider contacting the supervising attorney for clarification. </p>
<p>&#13;</p>
<p>Citing sources, especially authoritative sources, adds credibility and legitimacy to any analysis, especially in the law. In the legal field, legal precedent is critical so it is important to cite those relevant authorities. Many practicing lawyers will often look to recent law review articles or judicial opinions on how to properly cite authorities. When in doubt, it is always better to be on the side of caution and cite the source.</p>

<p> In New Hampshire, as in many other states, some people who have a DUI conviction are required by the court system to have an Ignition Interlock device (IID) installed in their motor vehicle as a condition of maintaining driving privileges. If the IID test indicates a result that is at or above the legal limit, the test data is automatically reported to the police and can result in DUI charges against the driver.</p>
<p>&#13;</p>
<p>“A major issue in cases like this is the accuracy and reliability of the evidence provided by the device” says DUI attorney Ryan Russman of Russman Law in Exeter, NH. He calls this issue: “trial by machine,” stating, “There are no witnesses other than this machine, and some of the most complex machines in the world can and do sometimes fail.&#8221;  </p>
<p>&#13;</p>
<p>ABOUT THE IGNITION INTERLOCK DEVICE</p>
<p>&#13;</p>
<p>An IID is installed in a car or other motor vehicle in order to measure the driver’s blood alcohol level. The machine requires the driver to present a breath sample prior to starting his or her vehicle. If the breath sample result is below a pre-set limit, the vehicle can be started normally. However, if the results of the breath test are at or above the pre-set limit, the interlock will interrupt the starter so that the vehicle cannot be started.  </p>
<p>&#13;</p>
<p>On face value, the IID is clearly a good tool for law enforcement officials and all concerned about increasing public driving safety. The companies that market the devices state that IIDs can be used effectively to help reduce accidents due to impaired driving or driving while intoxicated (DUI).  </p>
<p>&#13;</p>
<p>“For New Hampshire drivers who have been previously convicted of DWI, .02% blood alcohol level is the limit that our justice system allows as a safe level,” explains Exeter DWI lawyer Ryan Russman. “An IID result of .02% or above results in an administrative hearing that could result in additional license-suspension time, causing very serious consequences for people.” </p>
<p>&#13;</p>
<p>But can the results of an IID device be taken at face value? Or should they?</p>
<p>&#13;</p>
<p>DUI TESTING AND DEFENSE EXPERT </p>
<p>&#13;</p>
<p>DUI Attorney Russman is widely acknowledged as an expert in DUI testing and defense and has authored two well-known books on DWI in New Hampshire: one for other lawyers, one for citizens. He has also published dozens of informational DUI videos on drunk-driving and related topics.</p>
<p>&#13;</p>
<p>Russman is Board Certified by the National College for DUI Defense (NCDD), the only American Bar Association (ABA) accredited Board Certification program for DUI defense. <p>Legal aspects include illegal interrogation, due process, search and seizure, denial of counsel, and evidentiary issues. Scientific aspects include breath, urine or blood, and physical testing involving test technology and processes, biology, chemistry, toxicology, physiology and more. </p>

<p>This in-depth study of testing technologies gives Attorney Russman cause to challenge the results of the IID, or at least to ask the legal system to consider possibilities that could cause the machine to give a false positive result.  </p>

<p>THE PUBLIC IS ENTITLED TO A HIGHER LEVEL OF SCRUTINY</p>
<p>&#13;</p>
<p>Russman explains that IIDs use what is called fuel cell technology. This relatively new technology has not yet been subject to challenge in the courtroom.  The IID measures the coefficient of alcohol to breath and assumes a corollary of alcohol to blood.    </p>
<p>&#13;</p>
<p>Judiciaries and the court system are relying on IID machines to provide evidence that can result in DUI convictions, but Russman believes that the technology is subject to challenge. “People should not be convicted of a violation based on trial by machine,” asserts Ryan Russman.  </p>
<p>&#13;</p>
<p>Russman says, “Even though these machines may work well for most people, everyone metabolizes alcohol differently and, although they may be exceptions to the rule, there are various reasons why an IID could give a false positive result. People are entitled to a closer, more careful investigation of the evidence. Serious consequences hang in the balance &#8212; people’s jobs and relationships are at stake.”  </p>
<p>&#13;</p>
<p>A false positive IID result is a result that indicates an individual’s blood alcohol level is at or above the .02% threshold level when, in fact, it is not.</p>
<p>&#13;</p>
<p>WHAT COULD CAUSE A FALSE POSITIVE RESULT?</p>
<p>&#13;</p>
<p>First of all, the machine can simply malfunction. This happens with many different test instruments in clinical and research laboratories from time to time, sometimes with no clear reason why. Or a person could have someone else blow into the device.  </p>
<p>&#13;</p>
<p>“Everyone’s metabolism reacts differently to conditions, depending on body mass and lung volume, and that can change the equation dramatically;” says Russman, “reasons for a false positive result could be any one of a number of things.”  </p>
<p>&#13;</p>
<p>“A cold medicine could trigger a .02% reading on its own. Some diabetic people could cause a false positive IID test results based simply on the fact that their body metabolizes food differently. Gases and chemicals in cars can trigger false positives.  People with acid reflux problems can have residuary alcohol on their breath from stomach contents.”  </p>
<p>&#13;</p>
<p>“This whole methodology, though promising, is still subject to real questions and challenges,” says Ryan Russman. Given the many questions about the accuracy of the IID results, Attorney Russman believes that, “in trial by machine cases, unsupported data provided by an IID machine should be open to challenge in the courtroom.”</p>

<p> Lonestar Soccer Club today announced that its Executive Director of Coaching, Sean Bubb, received a prestigious national award earlier this year.  Bubb was named National Soccer Coaches Association of America (NSCAA) National Youth Coach of the Year at the annual NSCAA Convention Awards Ceremony held in Baltimore.  NSCAA is the largest coaching association in the world and, since its founding in 1941, has grown to include more than 30,000 members who coach both genders at all levels of the sport.   This award for Bubb brings national-level recognition of him, but also recognition of the strength of Austin-area youth soccer.</p>

<p>Lonestar moves into national spotlight under the leadership of Sean Bubb, recognition by the National Soccer Coaches Association of America (NSCAA)</p>

<p>Paul Payne, president of the NSCAA, commented, “This award is quite a testament to the outstanding work that Sean has done over the years to grow the game at the youth level. To be recognized by your coaching peers with the Youth National Coach of the Year award puts him in elite company among coaches who are involved in youth soccer.  His tireless efforts to promote the game as well as his commitment to teaching the players make him a worthy recipient of this award. On behalf of the NSCAA we offer congratulations.”</p>

<p>Upon receiving the award Bubb commented, &#8220;This is an award for the entire club, the players, staff and volunteers. It is recognition of the hard work put in day after day by the players and coaches.&#8221;  He added, &#8220;We are very proud of the opportunities our players and teams now have.”</p>

<p>Coach Bubb, a native of Rossington, England, grew up playing soccer, the game he loved.  He switched from playing to coaching in 1989 when he moved to the US and became the assistant coach at UNC-Charlotte.  Sean progressed through the coaching ranks with experience in the college game and the youth game.  </p>
<p>&#13;</p>
<p>Since 1990, Sean has coached numerous regional and national level players and teams in North Carolina and, more recently, in Austin, while also being a part of the Olympic Development Program Region III staff for 15 years.</p>
<p>&#13;</p>
<p>In 2000 Sean earned the UEFA ‘A’ Coaching License, at Stranmillis University College, Belfast, from the Irish Football Association (IFA).  “We want to congratulate Sean on achieving this award following so many years of service to the great game. It’s exciting to see the growth of the game in America,” said Nigel Best, Performance Manager and Head of Coach Education at the Irish Football Association.</p>

<p>Austin-area Lonestar Soccer Club president, Rod Favaron, believes the award is just the beginning for Lonestar, “This is great for Sean and the club is very proud of his achievement, though it comes as no surprise. <p>Applications are invited for ten Postgraduate Scholarships in MSc Veterinary Epidemiology and Public Health by distance learning.  </p>
<p>&#13;</p>
<p>The scholarships are available, for the first time, to nationals of Mozambique, Tanzania and Zambia, with the deadline for application on Monday 28 May 2012.  Applicants must also be living and working in these countries.</p>
<p>&#13;</p>
<p>Funded by the Commonwealth Scholarship Commission, academic direction is provided by the Royal Veterinary College (RVC), a constituent College of the University of London. The RVC is partnered by the Southern African Centre for Infectious Disease Surveillance (SACIDS), in the delivery of this programme. </p>
<p>&#13;</p>
<p>The MSc is being offered via distance learning. However, the programme is supported by a wealth of online resources and support, in addition to annual residential teaching workshops. </p>
<p>&#13;</p>
<p>Dr. Christine Thuranira-McKeever, Distance Learning Director at the RVC said: “These scholarships are a great opportunity for veterinary and other animal health specialists to benefit from postgraduate training in veterinary epidemiology and public health; these subject areas are essential when addressing issues such as disease surveillance, zoonotic diseases and trade and market access for animal products.”</p>

<p>She added: “The scholarships will offer a unique opportunity for animal health specialists to further develop their knowledge and skills, which will ultimately enhance the veterinary capacity of their countries, and more widely, the Southern African region.”</p>

<p> The traditional weekly day of rest could soon become the day of fiercely friendly competition, as Ultimate Spelling™ encourages families up and down the United States to join their ‘Spelling Sunday’ campaign.</p>

<p>The move hopes to encourage families to devote a few hours each week to indulging in competitive spelling games with a view to improve skills.</p>
<p>&#13;</p>
<p>Marc Slater, Managing Director of the company behind Ultimate Spelling™, explains a bit more about what’s in store:</p>

<p>Eye Spy – This timeless classic is actually an educational goldmine. It’s great for helping kids focus on which common household items are associated with each letter of the alphabet.</p>

<p>End-Letter Geeks – Someone spells a word, and the next player has to spell a related word that starts with the last letter of the previous word.</p>
<p>&#13;</p>
<p>As Slater explains, while the key is to make things educational and productive, Spelling Sundays can’t be effective without a bit of fun.</p>

<p>“It should certainly be very different to school. Families should crack open some snacks, make it light hearted and even consider inviting over friends or other families with small children to make it a bit of a festivity” he adds.</p>
